- Scope of Application
These Terms and Conditions govern access to and use of the website madebygenesis.com and all creative, strategic, and digital services (“Services”) provided by Genesis by Neptunys, a division of Neptunys Ltd.
By engaging our Services, the Client agrees to be bound by these Terms.
- Services
Genesis by Neptunys offers full-package brand creation including but not limited to strategy, identity, packaging, content production, website development, and post-launch support.
Each project duration ranges from 30 to 90 days, depending on scope and complexity.
- Proposals and Acceptance
Quotations or proposals issued by Genesis by Neptunys are valid for 14 days.
A project begins once the Client provides written acceptance and payment of the initial deposit.
- Payments and Billing
A 50 % deposit is required to initiate any project.
The remaining 50 % balance is due upon completion and before delivery of final assets.
Payments are non-refundable once creative work has started.
Genesis by Neptunys may suspend services for late or incomplete payments.
- Refund and Cancellation Policy
No refunds are issued once production or design work has begun.
If the Client cancels before work begins, Genesis by Neptunys may deduct administrative costs.
If the Client is inactive for 30 consecutive days, the project is placed on standby and a £50 restart fee applies when resumed.
If Genesis by Neptunys cancels a project for internal reasons, a proportional refund may be granted.
- Intellectual Property and Usage Rights
All materials, drafts, and concepts remain the property of Genesis by Neptunys until full payment is received.
Upon full payment, exclusive rights to final deliverables are transferred to the Client.
Genesis by Neptunys retains the right to display completed work in portfolios, case studies, and promotional materials.
Any unlicensed use prior to full payment constitutes a breach of contract.
- Client Responsibilities
The Client must provide all required information, content, and approvals within agreed timelines.
Delays in Client communication may extend delivery schedules.
- Post-Launch Support
Genesis by Neptunys provides 30 days of post-launch technical and brand support, followed by ongoing support until the Client’s business reaches £10 000 profit per month.
Subsequent support or maintenance may be purchased under a separate agreement.
- Limitation of Liability
To the maximum extent permitted by law, Genesis by Neptunys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for loss of profits or revenue arising from the use of its services or deliverables.
No warranty is given regarding specific commercial results, sales performance, or search-engine ranking.
- Confidentiality
Both parties agree to keep all project information and data confidential, except where disclosure is required by law.
- Force Majeure
Genesis by Neptunys shall not be held responsible for failure to perform obligations due to causes beyond its control, including natural disasters, strikes, network failures, or governmental restrictions.
- Jurisdiction
These Terms are governed by and construed in accordance with the laws of the United Kingdom.
Any dispute shall be submitted exclusively to the competent courts of Manchester, UK.

- Devis et acceptation
Les devis sont valables 14 jours.
Le projet commence après acceptation écrite et versement de l’acompte initial.
- Paiements et facturation
50 % d’acompte à la commande.
50 % restant à la livraison des fichiers finaux.
Aucun remboursement après démarrage du travail créatif.
En cas de retard de paiement, les services peuvent être suspendus.
- Remboursements et annulations
Aucun remboursement après le début de la production.
Si le Client annule avant démarrage, des frais administratifs peuvent être retenus.
Inactivité de 30 jours = mise en stand-by du projet + frais de redémarrage de 50 £.
En cas d’annulation par Genesis by Neptunys, un remboursement proportionnel peut être accordé.
- Propriété intellectuelle
La propriété des travaux reste acquise à Genesis by Neptunys jusqu’au paiement intégral.
Après paiement complet, les droits d’exploitation sont transférés au Client.
Genesis by Neptunys conserve le droit de présenter les projets dans son portfolio.
Toute utilisation avant paiement intégral constitue une violation contractuelle.
- Obligations du Client
Le Client fournit toutes les informations et validations nécessaires dans les délais convenus.
Tout retard peut entraîner un décalage du calendrier.
- Support post-lancement
Genesis by Neptunys assure 30 jours de support technique et créatif, puis un accompagnement continu jusqu’à ce que le Client atteigne 10 000 £ de bénéfice mensuel.
Au-delà, un contrat de support supplémentaire peut être souscrit.
- Responsabilité limitée
Genesis by Neptunys ne pourra être tenue responsable des dommages indirects ou consécutifs, ni de toute perte de profit ou de revenu résultant de l’utilisation de ses services ou livrables.
Aucune garantie n’est fournie quant aux résultats commerciaux ou performances spécifiques.
- Confidentialité
Les parties s’engagent à garder confidentielles toutes les informations liées au projet, sauf obligation légale de divulgation.
- Force majeure
Genesis by Neptunys ne sera pas responsable des retards ou défaillances dus à des événements indépendants de sa volonté.
- Compétence juridique
Les présentes conditions sont régies par le droit du Royaume-Uni.
Tout litige sera porté devant les tribunaux compétents de Manchester (UK).
